Update: Green Space Encroachments

The City of Georgetown contacted the Bradford Place HOA in mid-2017 and advised of encroachments into the open green spaces throughout our neighborhood. A letter was sent to all effected at that time. Since then, the HOA has conducted four dedicated meetings to address these issues. The Georgetown City Attorney and City Engineer attended one of those meetings and advised the board that these encroachments would need to be resolved. 
 
The City Attorney clarified that the green spaces located in Bradford Place are designated as 'Public Ways' akin to public parks, and stated that these encroachments are in violation of city ordinance 302.2.10, stating: "Public ways not to be obstructed. No owner, occupant or person otherwise responsible for the care and maintenance of premises shall construct, place or otherwise allow the construction or placement of any item that in whole or in part extends beyond the property line of the premises into space comprising a public way as defined in section 202 General definitions."

Further, the HOA has been in contact with the Georgetown Planning and Zoning Commission to inquire about the possibility of selling a portion of the green space behind each house to the homeowners. We since have learned that this option would not be approved.  

Thus, the board is left to request voluntary compliance from residents in removing all structures from the green space by July of 2018. After this time, the city will require the HOA to take appropriate measures to assure all encroachments are removed.  As we have stated at all of our meetings, once structures are within each resident's own property lines the HOA is not involved with any potential encroachment issues.
